This document sets out, in accessible terms, the refund provisions applicable to purchases of games and digital content made through BestGameStorm.online, the trading name of OR Tech Ltd UAB, a private limited liability company incorporated and registered in the Republic of Lithuania under company registration number 305913438, with its registered office at Perkūnkiemio g. 13-91, Vilnius, LT-12114, Lithuania.
This Policy is supplementary to, and forms part of, our Terms and Conditions. It is subject to, and shall be construed in accordance with, your statutory rights as a consumer under the Law on Consumer Protection of the Republic of Lithuania (Lietuvos Respublikos vartotojų teisių apsaugos įstatymas), the Civil Code of the Republic of Lithuania (Lietuvos Respublikos civilinis kodeksas), the EU Consumer Rights Directive (2011/83/EU) as implemented into Lithuanian national law, and all other applicable EU consumer protection legislation. Nothing in this Policy shall derogate from or otherwise diminish your inalienable statutory rights.
Particular restrictions apply to the sale of digital goods that do not apply to the sale of physical goods, and these are set out in full below. Refunds shall not be granted solely on the ground of dissatisfaction with a product, nor where your hardware, software, or other device fails to satisfy the minimum system requirements applicable to the game in question. Purchases effected via a virtual private network (“VPN“), proxy server, or any analogous circumvention technology may fail to function correctly; such purchases shall not, as a general rule, be eligible for a refund.
Refunds or store credit may be issued solely at BestGameStorm.online’s discretion, and each request is evaluated individually on its own particular facts and circumstances, with due regard to the following conditions:
The request for a refund or store credit must be submitted within 7 days of the date and time of purchase;
The game must not have been downloaded or activated by any means, including through keyless redemption processes;
The game activation key (including any associated bonus or beta access keys) must not have been disclosed to you, whether by e-mail, on-screen, or by any other means; and
The request must not be submitted within the period of 48 hours immediately preceding the game’s scheduled commercial release date or the commencement of its preload period.
Notwithstanding any other provision of this Policy, refunds shall not be granted in the following circumstances:
You express dissatisfaction with the game’s content, narrative, gameplay, or overall quality;
Your hardware or software does not meet the minimum system requirements specified for the game;
The purchase was effected through a VPN, proxy server, or similar circumvention technology;
The activation key has already been disclosed to or retrieved by you;
The game has already been downloaded or activated; or
The request is submitted outside the applicable timeframe prescribed by this Policy.
As a consumer habitually resident in the European Union — including in the Republic of Lithuania — you are afforded a statutory right of withdrawal under the EU Consumer Rights Directive (2011/83/EU), as transposed into Lithuanian law through the Law on Consumer Protection of the Republic of Lithuania and the relevant provisions of the Civil Code of the Republic of Lithuania.
The 14-Day Cooling-Off Period
You have the right to withdraw from the contract — without being required to give any reason and without incurring any penalty — within 14 calendar days commencing on the day immediately following the date on which the contract is concluded (the “Cooling-Off Period“).
Forfeiture of the Right of Withdrawal in Respect of Digital Content
Pursuant to Article 16(m) of the EU Consumer Rights Directive, your right of withdrawal in respect of digital content — including game download codes and activation keys — shall be extinguished prior to the expiry of the Cooling-Off Period where, before the expiry of that period:
You commence downloading the Product; or
You receive the activation key for the game, by whatever means of communication; or
We commence the supply of digital content and you have provided prior express consent to supply commencing before the expiry of the Cooling-Off Period, and have expressly acknowledged that you thereby irrevocably forfeit your right of withdrawal.
Where you provide such express consent and acknowledgment at the time of placing your Order, the supply of the game or activation key shall commence immediately upon confirmation of your purchase, and your right of withdrawal shall be extinguished from that moment.
Where you do not provide such express consent, we shall refrain from supplying the Product until the 14-day Cooling-Off Period has fully elapsed.
Procedure for Exercising Your Right of Withdrawal
To exercise your statutory right of withdrawal within the Cooling-Off Period, you must notify BestGameStorm.online of your decision to withdraw by means of an unequivocal written statement. Such notice may be submitted by:
Sending an e-mail to support@BestGameStorm.online, clearly identifying your name, order reference number, and your intention to withdraw from the contract; or
Using the contact form available on our Website.
You may use the following model withdrawal declaration, though its use is entirely optional — any clear and unequivocal statement of withdrawal shall suffice:
“I/We hereby give notice of my/our withdrawal from the contract for the purchase of the following digital content: [Game title], Order reference number: [Order number], Purchased on: [Date of purchase].”
We will acknowledge receipt of your withdrawal notice without undue delay.
Reimbursement Following Valid Withdrawal
Where you validly exercise your statutory right of withdrawal within the Cooling-Off Period, BestGameStorm.online will reimburse all payments received from you, including any applicable delivery charges, without undue delay and in any event no later than 14 calendar days from the date on which we receive your withdrawal notice.
Reimbursement shall be effected using the same payment method as was used for the original transaction, unless you have expressly agreed to an alternative method. You shall not be subject to any fees or charges as a consequence of such reimbursement.
Where a Product is defective, fails to correspond to its description, or otherwise fails to conform to the contract, you may have additional and overriding rights under Lithuanian law and applicable EU consumer protection legislation, irrespective of whether the general conditions for refund eligibility set out above are satisfied. In such circumstances, you are invited to contact us at support@BestGameStorm.online, and we will assess your request in accordance with your full statutory entitlements.
Where you are not satisfied with our response to a refund request or complaint, the following avenues for redress are available to you:
You may submit a complaint to the State Consumer Rights Protection Authority of the Republic of Lithuania (Valstybinė vartotojų teisių apsaugos tarnyba – VVTAT), the competent national authority for consumer protection matters, at Pradžia – Valstybinė vartotojų teisių apsaugos tarnyba , by telephone, or in writing at its published address.
You may alternatively submit a complaint through the European Commission’s Online Dispute Resolution (“ODR”) platform, accessible at Site relocation , which provides a centralised, multilingual online facility for the out-of-court resolution of disputes between consumers and online traders established within the European Union.
